Omar Abdullah - be within ambit of Indian constitution | HAWA MAIN TEER MAT CHALAO | | R.B.SURI
Now a days after having ruled the state of Jammu and Kashmir for one term in an alliance with INC, Omar Abdullah is raising the bogey of the Sadar-e- Riyasat and Prime Minister for the state in terms of the Instrument of Accession signed by the Maharaja of Jammu and Kashmir Hari Singh in October 1947, just for exploiting the people of the valley against the Indian government for his party's vested interests. Three days back only, the Prime Minister of India Narender Modi has given him the rebuff while addressing an BJP election rally at Hyderabad, Prime Minister Narendra Modi cornered Congress and the grand alliance parties over National Conference leader Omar Abdullah's remarks for a separate Prime Minister for Jammu and Kashmir. At the same time, BJP President Amit Shah declared that Article 370 and 35-A will be scrapped once the BJP achieves majority in the Rajya Sabha in 2020. "Two Prime Ministers for Hindustan? Do you agree with it? Congress has to answer and all the 'Mahagathbandhan' partners have to answer. What are the reasons and how dare Omar says? Modi stated at an election rally in Hyderabad referring to the comments made by Omar Abdullah a few days back day in Srinagar demanding separate Prime Minister for Jammu and Kashmir. PM Modi stated that he also wants to ask Trinamool Congress Chief and West Bengal Chief Minister Mamata Banerjee, former Prime Minister H. D. Deve Gowda, Andhra Pradesh Chief Minister N. Chandrababu Naidu and NCP Supremo Sharad Pawar whether they agreed with Omar Abdullah's statement? "I want to ask Bengal Didi who shouts a lot, do you agree with it ? Answer the people. Uturn (Chandrababu) Babu with whom Farooq Abdullah campaigned recently in Andhra Pradesh. Do you think Naidu should get votes? NCP's Sharad Pawar and former Prime Minister H D Deve Gowda, whose son is Karnataka CM, should also answer. Would you like to go with them (Mahagathbandhan) or break away from them ?" Modi asked. Meanwhile, BJP President Amit Shah in an interview to a news channel stated the BJP was firm on its stand on Article 370 and 35-A right from the days of Jan Sangh and there has been no change in it. "The Articles couldn't be abrogated as the BJP didn't have majority in the Rajya Sabha at the moment. It will happen only in 2020 when we 'II get majority in the Rajya Sabha.'' Shah made it very clear that the Articles 370 and 35A of the Indian Constitution would be scrapped in 2020 after BJP would get majority majority in Rajya Sabha. It is worth mentioning over here that National Conference(NC) is such a political organization which fought against the autocratic rule of the Maharaja of Jammu and Kashmir prior to 1947. It launched a decisive struggle for the Lokraj in the state of Jammu and Kashmir. National Conference a Regional political party of the state was founded by a tall leader of the masses Sheikh Mohammed Abdullah. Sheikh was a farsighted leader of the state who would be remembered for all times to come for bringing a revolutionary law on the Agrarian reforms and over the Defections. J&K Agrarian Reforms Act and the J&K Anti defection Act are the important Legislations of the state for which the tall leader was very much interested. Besides, Khatma Chackdari Act and Numberdars Act were totally repealed in this state. Sheikh Mohammed Abdullah remained as the Prime Minister of the state from 1947 and onwards up to 1953 when he was detained in the Kashmir conspiracy case and was put behind the bars. From 1953 to 1975, Sheikh Mohammed Abdullah remained in the Jails in and outside the state in Kashmir conspiracy case. In 1975, he was given the powers of the state under Kashmir Accord signed by him and the Prime Minister of India Md. Indira Gandhi. The former Chief Minister Mir Qasim paved the way for accommodating Sheikh Mohammed Abdullah as the Chief Minister of the state of Jammu and Kashmir. After his death in 1983, his eldest son Dr. Farooq Abdullah took over the reigns of the state as the Chief Minister. Most of the Central legislations passed by the Indian Parliament have been extended from the period from 1953 and onwards now still the process of extending the laws passed by the Indian Parliament is on. This is a clear cut evidence that the Indian Parliament and the Apex Court have established their supremacy in the state of Jammu and Kashmir. Pertinent to mention here that National Conference on its own as also in alliance with INC have ruled the state in the past. The chapter of Sadar-e- Riyasat and Prime Minister was closed during the regime of the great patriot and the former Prime Minister Lal Bahadur Shastri in 1965 when the state was being governed by the INC. At that time the nomenclature of the Institutions of the Sadar-e- Riyasat and Prime Minister for the state in terms of the Instrument of Accession signed by the Maharaja of Jammu and Kashmir Hari Singh in October 1947,were changed and certain other measures were taken to demolish the barriers hitting the state affairs. Branch of INC was established at that time and earlier the Congress people in the state were operating under the banner of National Conference. There was no role of the Election Commission of India ( ECI), Supreme Court of India, Comptroller and Auditor General of India. Sheikh Mohammed Abdullah entered into an accord with the then Prime Minister of India Madam Indira Gandhi in 1975 after having remained in the various jails in the state as also outside the state since 1953 and Omar Abdullah was just a child in 1975. During the J&K Assembly elections 2008, the National Conference won the elections and got the maximum number of seats and formed a Coalition Government in J&K State with the Indian National Congress. Omar Abdullah led the Coalition Government in the state for six years in an alliance with the Indian National Congress and made the mess. Since Omar was not having an experience in the financial field at all and throughout he remained dependent on his Finance Minister Abdul Rahim Rather and his close Ali Mohd. Sagar. Prior to becoming Chief Minister of Jammu and Kashmir Omar worked as Minister of State in NDA led Union Government headed by the then PM Atal Behari Vajpayee. People at large in the valley out rightly rejected them because of their inefficiency in working during the six years rule. They made a way for the next Government in the State of Jammu and Kashmir. The people of the State at large through their right to franchise played their positive role in the elections to the J&K Legislative Assembly in 2014. Their coming out from the houses in very large numbers in taking active part in participative the elections process have strengthened the very roots of the Parliamentary democracy in the country in general and the State in particular. Their role was magnificent and appreciable because of the reason that they had shown the Separatists and the militant outfits the out gates thereby rejecting their dictates and boycott calls for not taking part in the Government of India governed electoral process in the State of Jammu & Kashmir. The electorates of the State had, in totality, given the verdict for a "Hung Assembly' in accordance with the the capabilities and intelligence of their beloved leaders in bringing them out from their sufferings. Results of the recently constituted J&K Legislative Assembly were declared by the Chief Electoral Officer of J&K by the evening of 25-12-2014. Based on the results, the 12th J&K Assembly was constituted on 29-12-2014.In the elections, PDP secured 28 MLAs, BJP got 25 MLAs ,NC got 18 MLAs, INC got 12 MLAs PC got 2 MLAs and others 2 MLAs. After a period of three months , an Agenda of Alliance was stitched between the BJP and the PDP based upon which Syed Mufti Mohammed took the reins the governance of the state as the Chief Minister in March 2015 at Jammu. After his death, Mehbooba Mufti led the Coalition Government of BJP and PDP up to June 20 last year. The Coalition Government of BJP and PDP remained a total failure which brought the state to the present volcanic stage. Omar Abdullah is a honest personality beyond any doubt and is a man of commitment. But the only thing is that he takes the things lightly with the result he gets defeated always. Certainly one thing is there that being 3rd generation of his Grandfather Sheikh Mohammed and after his father Dr. Farooq Abdullah , he got an opportunity to serve the people of the State for six years. His deeds and actions are before the Public. Boycotting of the Municipal and the Panchayat elections in the state was a mindless decision of National Conference indeed. As a responsible political party of the state, it should not have taken such a drastic and undemocratic decision. They must be repenting over this unwanted decision of National Conference. Due to their wrong notions, BJP remained successful in making the space for it in the ULBs and Panchayats of Kashmir valley. When we talk of Had they not boycotted these elections, BJP could have scored a big zero in these elections in the valley. There is also a big need for introspecting the factors which were responsible for their downfall while remaining in the Coalition Government with the pro Pak and Hurriayat group - PDP from 2015 onwards. People residing in the entire belt of Jammu Division feel ditched and dodged by BJP during their rule with PDP.Since Shah Faesal after resigning from the top IAS service has already launched his political party under the name and style as "J&K People's Movement " on March 17 at Srinagar. He is working hard these days and mobilizing the people of the state towards his party. Recently he has visited Jammu and addressed the public meeting and met with the various personalities and the various delegations. He is getting the very good response from the people of Jammu region at large. As and when the Assembly elections are held in the state, Shah Faesal would get the tremendous support from the people of the state for putting an end to the present ugly situation in the state. Therefore, it becomes very important for Omar Abdullah to apply the restraints on his sayings against the nation. He should try his best to remain within the ambit of the Indian Constitution. Not only this, Dr.Farooq Abdullah and Mehbooba Mufti are continuously exploiting the people of the valley for their vested political interests on the issue of Article 370 and Article 35A (which sub judice before the Apex Court) and saying day and night that any tinkering with these Articles of the Indian Constitution by the Central Government will lead to the destruction of the state and it will not be the part of India in future. This is their total foolishness. They should remain within their limits otherwise they will be subjected to face the consequences and the results. It may be they will be put behind the bars as "Desh Drohis" in a criminal conspiracy case as was done with Sheikh Mohammed Abdullah in 1953. Since the chapter of Sadar-e- Riyasat and Prime Minister for the state has already closed in 1965, it looks foolish to touch the same time and again. Let's all should think of the overall development and the prosperity of the state, come what may. |
