One year imprisonment, Rs 5 lakh fine in cheque bounce case | | | Early Times Report JAMMU, Oct 10: Special Railway Magistrate Jammu Parvaiz Iqbal today awarded one year imprisonment and fine Rs 5 lakh to Naveen Jaswal son of Dev Raj of Rehari Colony, Jammu in a cheque bounce case. Court after hearing Adv CM Sharma for the National College of Education, Purkhoo observed that the accused managed to arrange and get admission of various students from outside the state of J&K, in the college of the complainant to undergo one year B.Ed course. The accused paid the annual tuition fee of those students through two different cheques i.e. vide cheque no.040125 dated 24.09.2014 for an amount of Rs.2.00 lakh and vide cheque no.040126 dated 24.09.2014 for an amount of Rs.2.95 lakh total amounting to Rs.4.95 lakh drawn at the J&K Bank Ltd branch office JKBOSE, Rajpora Road, Rehari, Jammu to the complainant in discharge of his debt and liability. Special Railway Magistrate Jammu after hearing Adv CM Sharma for the complainant whereas Adv Ankush Jamwal for the accused person observed that so in these circumstances, the accused Naveen Jaiswal, is found guilty of offence under Section 138 Negotiable Instrument Act and is thus convicted. He is sentenced to undergo simple imprisonment for a period of one year and a fine of Rs 5 lakh is also imposed. In the event of default in payment of fine, the convict shall undergo imprisonment for a further period of six months. Special Railway Magistrate Jammu Parvaiz Iqbal further observed that it would be apt to highlight that S. 138 of the Negotiable Instrument Act 1881, has been incorporated in Statute to make the person dealing in commercial transaction work with a sense of responsibility. It is intended to usher a new healthy commercial morality through the instrumentality of the Penal Law. (JNF) |
