Duplicate cement manufacturing case | Court acquits accused as prosecution fails to prove guilt | | EARLY TIMES REPORT
UDHAMPUR, Sept 1: The Sub Judge, Chief Judicial Magistrate Udhampur, Mohd Rafiq Chak , acquitted the accused involved in a case for their alleged involvement in manufacturing duplicate cement of major brands like Ambuja and ACC after six years of trial as the prosecution failed to prove charges against the accused persons for the commission of the offences punishable under Section 420/382/34 RPC and 3/7 EC Act , for want of cogent, credible and trustworthy evidence. Court heard argument of APP who appear on behalf of state while Advocate Sandeep Bhat who appear for the accused. Judge delivering judgment said that prosecution miserably failed to prove the accusation against the accused by leading cogent and plausible evidence as result of which challan is dismissed and accused no 1 is acquitted of the charges under section 3/7 EC Act read with 420/482/34 RPC. As regards to other accused who have been proceeded under 512 Cr Pc, Court said that there is nothing against them as well and their presence before the court after being arrested in execution of warrant of arrest under section 512 Cr Pc shall be a bare formality only Court also directed SHO Udhampur to hand over seized cement and other items as per seizure memo along with Godown to the accused forthwith.
