DB reverses Single Bench order against PSC, Health Secy | | | EARLY TIMES REPORT JAMMU, Feb 11: The Division Bench of Jammu and Kashmir High Court on Thursday reversed the order of the Single Bench against the Public Service Commission and the Health Secretary. In a LPA filed by Union Territory of J&K challenging the judgment of writ court whereby the court had imposes costs of Rs one lakh on Public Service Commission and Health Secretary, the Division Bench of J&K High Court comprising Justice Ali Mohammad Magrey and Justice Puneet Gupta allowed the appeal and set-aside the costs of Rs one lakh and suo-moto contempt initiated by the single bench During the course of hearing, the Division Bench observed that the writ court while adjudicating upon batch of writ petitions which called in question the selection process for the post of Deputy Medical Superintendent advertised in terms of Notification No. 16-PSC of 2005 dated 13.10.2005, took into consideration many factors involved in the matter such as the age of the petitioners; the time spent during the pendency of the writ petitions and accordingly dismissed the writ petitions. Senior Additional Advocate General HA Siddiqui represented the J & K Government. |
