Despite High Court order, influential BDC Chairman continues to operate brick kiln illegally
Revenue officials ignore order, fail to stop illegal operation

Jammu, May 1: Despite High Court order to stop operation of illegal brick kiln at village Dher, Phinter of Tehsil Billawar of District Kathua, an influential Block Development Council (BDC) Chairman Billawar, who is also the owner of the brick kiln, has been continuously running its operation illegally due to slackness on the part of the competent authority to check this un-regulated working.
As per documents, M/S Sheetla Brick Kiln owned by Ashok Kumar (BDC Chairman Billawar) at Village Dher, Phinter, Tehsil Billawar, District Kathua situated at Phinter, Kathua is continue to operate without renewal of the license and requisite permissions from the concerned authorities.
The issue was brought to notice of authority through his PIL before the High Court of J & K And Ladakh, at Jammu which got registered as CM no. 3466/2021 with PIL No. 22/2016, wherein which, the Division Bench of High Court of Jammu & Kashmir and Ladakh at Srinagar, vide its order dated 03-09-2021 was pleased to direct that Sh. Ashok Kumar shall not run the Brick Kiln in question if his permissions/license has expired and has not been renewed.
That later on, vide order dated 20-10-2021 the CM No. 3466/2021 was de-tagged from the aforesaid PIL and has been ordered to be listed as a separate Writ Petition before the single bench of Jammu wing.
The CM No. 3466/2021 was registered as WP No. 2472/2021 and listed on 30.11.2021 before the High Court of Jammu and Kashmir and Ladakh at Jammu for consideration and the High Court vide its order dated 30-11-2021, held that also by way of interim directions, Ashok Kumar was restrained to operate the brick Kiln and categorically directed Deputy Commissioner, Kathua, to ensure that the order dated 3-09-2021 passed by the division bench is complied with in letter and spirit.
As per the direction of the High Court, a status report came to filed on 06.01.2022, wherein which it is maintained that a notice was issued by Tehsildar, Billawar Ashok Kumar with the directions to close the operation and functioning of Brick Kiln. It is also maintained that Naib Tehsildar Bhaddu has visited the spot on 03-01-2022 and reported that some raw material/unfinished bricks were found on spot, however the Brick Kiln was not functioning. The office of the Brick Kiln has been sealed and manager present there has been directed not to operationalize the Brick Kiln till disposal of the case by the High Court.
It has been alleged that the report furnished to the Deputy Commissioner, Kathua was evasive and reflect apparent non-seriousness on the part of the field officer concerned while executing order of the High Court and as the report nowhere mentions the stock of the Mud raw Bricks as the same are in lakhs. Further the Stock of the finished Bricks, the status of the land in and around the kiln from where the mud is procured to be used as raw material and videography of the Brick Kiln. The casualness with which the matter is attended can be gathered from the very fact that only within days of the alleged seizure of the office of the Brick Kiln, the seals of the same has been broken and the office is put to use again wherein construction of raw bricks has again started and with full force and this time more labour which counts more than hundred have been employed and besides the construction of raw bricks, permanent concrete structure has been started and completed as well.
The matter was again listed before the Court on 04.04.2022, wherein which the earlier directions passed by the Court has again been reiterated wherein which the Court has again directed Deputy Commissioner, Kathua shall ensure that Ashok Kumaris not permitted to run his brick kiln unless he has a requisite permission/license from the competent authority and has also directed you to submit report in this regard by the next date which is thus fixed for 11.05.20222.
Despite of the fact that the order and directions issued by the court from time to time have been very specific, categorical and unambiguous one and in to the knowledge and information, of the authorities concerned, nonetheless Deputy Commissioner, Kathua have allowed the same to be flouted and violated and no positive steps despite knowledge of the same have been taken, but authorities has opted not to comply with the same and as on date nothing concrete has been done in this regard or atleast the taking of any step by the office of Deputy Commissioner, Kathua in that direction as such Deputy Commissioner, Kathua is disobeying and/or violating the categoric and specific directions.
