CEO Doda sits on RTI plea, SIC issues penalty notice

Jammu, Jan 12: As the Chief Education Officer (CEO) Doda who is also the Public Information Officer (PIO) under State RTI Act sat on an RTI plea related to appointment of ReT teachers in Zone Bhalla for months , the State Information Commission (SIC) while taking this matter seriously has issued a penalty notice against the officer asking him reasons in writing for making such un necessary delay. As per details available with Early Times one B.R. Manhas, Advocate moved an application dated 29-03-2014 before the Public Information Officer/Chief Education Officer, Doda under J&K Right to Information Act, 2009 wherein he sought some information pertaining to engagement of RET Teachers in some upgraded schools of Panchayat Derka Zone Bhalla District Doda. The information included copies of application forms of all nine candidates , criteria for preparing the merit list , points scored by the candidates .
The Chief Education Officer, Doda vide office letter no. CEO/D/Monitor/722- 24 dated 04-04-2014 informed the applicant that the information requested has to be sought from Zonal Education Officer (ZEO) , Bhalla and he has intimated that the amount of expenditure as photostat charges is Rs. 170/- and postal charges is Rs. 50/- and requested the applicant to deposit an amount of Rs. 220/- under proper receipt within 10 days so that the information could be provided to him.
The applicant in compliance to the aforesaid request of the CEO, Doda deposited an amount of Rs. 230/- in the office of CEO, Doda on 19-04-2014. After receiving the cost of information, the CEO, Doda slept over the matter and applicant feeling aggrieved of inaction on the part of the PIO/CEO, Doda filed 1st appeal dated 15- 05-2014 before the Director, School Education, Jammu. The 1st Appellate Authority ( FAA)vide order no. DSEJ/Legal/6631-33 dated 18-06-2014 disposed of the appeal with a direction to CEO, Doda to provide the complete information to the appellant free of cost within a week's time from the date of pronouncement of the order under an intimation to the Directorate.
The CEO, Doda did not implement the orders of the Director School Education Jammu (FAA) order within a week's time as directed him and provided information to the information seeker vide office letter no. CEO/D/RTI/2364 dated 30-07-2014.
The appellant feeling aggrieved of the delay on the part of the PIO/CEO, Doda moved before the State Information Commission (SIC) by filing 2nd appeal dated 17-09-2014 in which the appellant has alleged that the CEO/PIO, Doda has committed the delay of 75 days despite the fact that the cost of information as directed was deposited in his office against proper receipt within the specified time.
The Commission after receiving the 2nd appeal listed the matter for hearing on 29-10-2014, 25-11-2014 & 02-01-2014. During the course of proceedings held on 02.01.2015 , the appellant apprised the Commission that the information provided is complete and as per RTI application and he would not press for the same. However, the appellant brought to the notice of the Commission that there is unreasonable delay on the part of the PIO/CEO, Doda in furnishing the information even after charging the cost of information as requested by him.
The SIC order reads as :
"The information already stands furnished to the information seeker and as such no further direction in the matter is required. However, there is a delay on the part of the PIO in furnishing the information to the information seeker and the appellant has identified Sh. Mohammad Ayaz Mughal the present incumbent/Chief Education Officer, Doda who is allegedly responsible for the delay. Mohammad Ayaz Mughal, CEO, Doda is hereby directed to show cause why penalty under section 17 of the J&K Right to Information Act, 2009 may not be imposed upon him for causing delay in furnishing the information to the information seeker within 3 weeks from the date of receipt of this order"
