SC upholds grant of bail to former Minister Shabir Khan | | | Early Times Report Srinagar, Jan 29: The Supreme Court of India has declined to set aside orders of Jammu and Kashmir High Court granting bail to former Minister of State for Health, Shabir Ahmad Khan in connection with alleged molestation attempt on a lady doctor here last year. "Taking into consideration that the investigation is complete and the charge sheet has been filed, we are not inclined to set aside the impugned order, whereby respondent No.1 (Shabir Ahmad Khan) has been extended the benefit of Section 497A of J&K Cr.P.C," said a Division Bench of Supreme Court comprising Justice Dipak Misra and Justice Prafulla C. Pant. The direction by the Apex Court followed after it was apprised, in the course of hearing, that the charge sheet has been filed against Khan. "As the charge sheet has been filed, we direct the trial Court to proceed in accordance with law," the court said and disposed off the special leave petition filed by the doctor, challenging the grant of bail to Khan. The former MLA from Rajouri has been charged by police under sections of 354 RPC (assault or criminal force to woman with intent to outrage her modesty) and 509 RPC (word, gesture or act intended to insult the modesty of a woman). The lady doctor had accused Khan of sexual harassment at winter secretariat in February last year. In her complaint, the doctor claimed that the Minister called her to his office on January 28 and tried to outrage her modesty. |
