DB disposes off petition with directions | PIL seeking neat & clean City of Jammu | | Jammu, Mar 18 : In a Public Interest Litigation filed by two practicing Advocates namely Deepak Singh Balouria & Bhanu Singh Salathia seeking direction to the respondents to strictly implement the provisions of the Essential Services (Maintenance) Ordinance, 2001 in letter and spirit so as to ensure a clean hygienic and healthy environment to the public at large, A Division Bench of State High Court Comprising Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat after hearing Adv Meenakshi Salathia appearing for the PIL disposed of PIL with directions to Jammu Municipal Corporation. Division Bench observed that when the matter was posted for admission, this Court ordered notice and directed the respondents to file status report, the status report has been filed by the respondent Nos.3 and 4 pursuant to the direction issued by this Court on 08.10.2014 which reads as it is submitted that the Jammu Municipal Corporation is striving hard to maintain hygienic conditions in Jammu City, so as to provide clean environment to the citizens. That the Corporation has undertaken sanitation drive under the name "Cleanup Jammu" in September 2013 covering different wards. During the drive special effort were made to ensure cleanliness of lanes, desilting of nallahs/drains, repairing of street lights, etc. That these drives alongwith the continuous efforts on the part of Corporation has resulted in seizure of 1064 Kg of polythene, realization of fine amounting of Rs.1.95 lacs and 811 challans during 2013-2014. That the Corporation has levied user charges in its 71 wards whereby, the residents/business establishments are paying the sanitation charges for the Municipal service being rendered. In 2013-14, Rs.93.86 lacs were collected on this account. After perusal of the Status report, Division Bench observed that it is evident that the Corporation has levied user charges in its 71 wards whereby the residents/business establishments are paying the sanitation charges for the Municipal service being rendered. In 2013-14, Rs.93.86 lacs were collected on this account. During the current financial year 2014-15, these efforts have been further supplemented to ensure improvement in the Municipal service. Division Bench observed in the light of the steps taken by the Corporation, this Court is satisfied with the stand taken by Jammu Municipal Corporation in the status report wherein it is also stated that 57 garbage bins, in addition to the existing stocks, and 20 twin bins have been installed during the last three months for effective collection and disposal of garbage. The Corporation must introduce twin bins in the remaining wards also for collection and disposal of the garbage within a period of three months from the date of receipt of a copy of this order. It is, however, made clear that, if there is any laxity on the part of the Corporation, it will be open for the petitioners to bring it to the notice of this Court. With these observations Division Bench disposed of the PIL.(JNF) |
