HC directs Com/Secy RDD to file compliance in 'contempt petition'

Srinagar, May 27: Taking harsh steps to deliver justice to common people, the Justice AM Magrey of J&K High Court Srinagar while hearing a contempt petition filed Mohammad Latief Ansari today directed Commissioner/Secretary Rural Development Department (RDD) to file compliance of the judgment if he fails to do so, he shall not draw his salary for the month of June 2015 onwards.
This direction has been passed in a contempt petition in which petitioner alleges violation of final order passed on 06/06/2008, in SWP No. 104/2005 titled Mohammad Latief Ansari V/s State and Others wherein High Court has allowed the petition with the directions to respondents to treat the petitioner as Panchayat Supervisor cadre against which post he is holding the lien and settle his seniority in the said service and provide him consequential benefits/promotions as are entitled to him under the service rules.
After the hearing the counsel of petitioner Justice AM Magrey observed that this contempt petition has remained on Board for the last three years, and during this period respondents have time and again sought time to file compliance. Court has adopted liberal approach and granted opportunity from time and again.
Court also said Commissioner Secretary to Government, Rural Development Department, shall file detailed affidavit indicating response to the observations made in the order with reference to implementation. Earlier Counsel for petitioner submits that on account of non-implementation of the final order passed by this Court, petitioner has suffered a lot because he has also retired from services on reaching the age of superannuation on 30th April 2013. Upon this Court directed In case Commissioner Secretary, Rural Development Department, fails to submit compliance of orders, he shall not draw his salary for the month of June 2015, onward. (JNF)
