SIC directs XEn to reveal detail of works executed in Gurez | | | Early Times Report SRINAGAR, June 24: The State Information Commission (SIC) has directed the Executive Engineer (XEn) R&B Special Sub Division Gurez to reveal 3 year details of works executed between 2012 & 2014 in the Special Sub Division . The said information was sought by a Bandipore resident which was denied to him earlier . Details available with Early Times reveals that one Ghulam Mohammad Lone S/o Ab Jabbar Lone R/o Mantrigam Bandipora, filed an appeal before State Information Commission (SIC) on 19.5.2015 2 under J&K RTI Act, 2009. The appellant submitted before SIC that he filed an RTI application on 28.10.2014 along with treasury receipt of fee for providing information of Tehsil Gurez from January 2008 to October 2014 . As no response was received against the RTI application, he filed First Appeal before the First Appellate Authority (FAA) / Superintending Engineer Ganderbal/ Bandipora on 05.12.2014 and requested for decision. In response to the appeal, SE vide his letter dated 27.12.2014 directed PIO to provide the information. As per records enclosed with the appeal, the information seeker Ghulam Mohammad Lone has sought information on 4 points regarding release/utilization of funds under various schemes, details of contractors, funds utilized for stores and information of advertisement notification of works published in daily news papers from January 2008 to October 2014. In the counter statement filed before SIC Srinagar dated16.06.2015, PIO/Executive Engineer Special Sub Division Gurez has submitted as the information sought by the applicant was huge for a period from January 2008 to October 2014, the applicant was asked vide letter dated 02.12.2014 to deposit Rs. 5745/- as Photostat charge in the Divisional Chest. That, the Technical Officer to SE PWD (R&B) also asked the applicant vide letter dated 22.04.2015 to deposit Rs. 5745/- on account of Photostat charges, which he failed to deposit . PIO has submitted that applicant did not respond to these correspondences but instead applied before the SIC by concealing some facts. The Information Commission during the case hearing on 18.6.2015 at Srinagar noted that information sought is in respect of all developmental works executed in Sub Division Gurez for a period January 2008 to October 2014, is voluminous. SIC in its order ruled, "the reply of PIO that information is huge, is agreeable. The Commission counseled appellant during hearing that compiling such voluminous information shall divert resources of the public authority and could not be provided in the form asked for. The appellant submitted that he is actually interest in information from 2012 to October 2014 which may be provided to him. This being fair and reasonable, is accepted. The Commission noted that information sought in respect of Point No. (III) pertains to name, addresses and contact details of the contractors. The Commission is of the view that this is personal information and does not serve larger public interest. Also, information at Point II pertains to Rural Development Department and hence not available with the PIO". |
