HC directs PWD Com/secy to initiate inquiry against AEE
Issuance of contradictory certificates by then AEE

Jammu, July 15 : Justice Tashi Rabstan of Jammu Kashmir High Court has directed Commissioner/Secretary, PWD (R&B), to initiate inquiry against then Assistant Executive Engineer (AEE) PWD (R&B) posted at Sub-Division, Banihal, with regard to the issuance of the contradictory certificates regarding distance and the court further directed the secretary PWD (R&B) to complete the inquiry within a period of six weeks and the report be submitted before the next date of hearing. He observed that it is contended that then AEE PWD (R&B) Sub-Division Banihal issued two certificates dated 05-01-2012 wherein distance from Shokerpora to Gujjarnar, Chachall has been shown 200 meters (approximately) and distance from Mirpora to Gujjarnar Chachall has been shown 180 meters (approximately).
It was contended that the same AEE PWD (R&B) Sub-Division Banihal has issued another certificate dated 09-01-2012 which is annexed as Annexure-R1 with the objections of private respondents wherein the distance from Village Chachall to Shakerpora to Upper Gujjarnar has been shown 1.90 km by foot (approximately). It was submitted that the said AEE has pushed the poor villagers of Banihal to an uncalled for litigation which is pending since 2010 and ultimate casualty is the students belonging to lower strata of the society. It was also submitted that distance certificates are issued by R&B and REW on pecuniary considerations which force the people to endless litigation in petty matters like RET, Anganwari and other contractual engagements. After going through both the certificates, Justice Rabstan observed that both these certificates are contradictory to each other. At this stage, the advocates submitted that this is a fit situation where disciplinary action should be directed against then AEE PWD (R&B) Sub-Division Banihal. After hearing both the sides, the judge directed that it would be appropriate to direct the Commissioner/ Secretary to Government PWD (R&B) to initiate inquiry against the AEE with regard to the issuance of the contradictory certificates regarding distance and the court further directed the secretary PWD (R&B) to complete the inquiry within a period of six weeks and the enquiry report be submitted before the next date of hearing.
