HC’s directive in PIL seeking effective prosecution wing | | | Early Times Report
jammu, July 23: In a PIL filed by Rufi Khan and others, seeking effective prosecution of criminal trials particularly involving capital sentence and life imprisonment with a view to prevent crime and manning of legal remembrance posts by judges, a high court division bench of Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal today observed that pursuant to June 11, 2014 order, the respondents were yet again directed by virtue of May 26, 2015 order to file comprehensive report indicating guidelines (whereby the earlier division bench directed state to file status report indicating guidelines for appointment of public prosecutors and additional public prosecutors), if any, for their appointment and also status of the recommendations of the committee headed by advocate general. The bench said the counsel for the respondents had submitted that a committee was being constituted to prepare a report indicating the guidelines for appointment of PPs and additional prosecutors. He assured the court that the needful would be done within a period of four weeks. The bench took serious note and observed that "We may observe here that despite order passed as back as on 11.06.2014, the state is still found struggling at the stage of constitution of appropriate committee for making concrete recommendations after collecting requisite data and inputs from various concerned quarters. However, we hope that the assurance given by the counsel for the respondents is not belied and an appropriate reply is filed by the next of hearing". (JNF) |
