Jammu, Sept 5:In an application seeking court permission to hold Shree Ganesh Mahotsav Yagya at Gandhi Nagar Dushera Ground, which is a sports ground maintained by the Sports Council, from September 17 to 27, a high court division bench of Justice Muzaffar Hussain Attar and Justice B S Walia observed, since the counsel appearing for the PIL had submitted that sports ground/playground is located in a densely populated area, which is also a hub of commercial activities and in the event, if permitted to be held in sports ground, would not only violate the orders of the Supreme Court but the orders of this court also passed in the aforesaid WPPIL No 20/2014. It was submitted that permitting an event of this nature, which is detailed out in the application, in the aforesaid playground would adversely affect the civic rights of the residents of the area and the commercial activities of the business class would also suffer. It was also submitted that the commuters will also face huge difficulties, if permission as sought by the applicant, is granted. After gone through the submissions made by the both the sides, the bench observed that the submissions made by counsel for the PIL, had persuaded us to take view that the application is not maintainable and dismissed the same. |
