Information on residential addresses of KP relief holders denied under RTI | SIC exempts disclosure accepting security apprehensions | | Avinash Azad
Early Times Report Jammu, Sept 6: Denying information regarding residential addresses of Kashmiri Pandit relief holders to seeker, the State Information Commission observed that information sought by the former cannot be disclosed as it may pose security threat for the community. According to documents available with Early Times, one Bhuvneshwar Gandotra moved an application before the PIO, office of the Relief and Rehabilitation Commissioner (Migrant), Jammu and sought information including name of head of family and its members, address in Jammu and address in Srinagar. The PIO, informed the information seeker that the said information has already been supplied and there was no extra information which can be shared. Appellant feeling aggrieved, filed first appeal before the First Appellate Authority/Relief & Rehabilitation Commissioner (M), Jammu and after that appellant knocked the doors of the Commission by filing second appeal. During the period of interregnum, appellant made several representations to the First Appellate Authority. The First Appellate Authority submitted before the Commission that the applicant had initially filed an application dated 17.03.2013 wherein he sought certain information of Kashmiri migrants registered in Relief Organization, Jammu. The desired information was provided to the applicant in a compact disc within the stipulated time. The First Appellate Authority further submitted that the applicant was informed that the addresses of registered migrants have not been provided because of the fact that a similar request providing of addresses had been objected to by the migrants owing to security reasons. Meanwhile, a group of Kashmiri Migrants approached the Relief & Rehabilitation Commissioner objecting to provide the details to the applicant stating that the sought information relates to a third party and be treated as confidential. The First Appellate Authority submitted before the Commission that due to the aforesaid reasons information sought by the information seeker could not be provided to the applicant and prayed that the second appeal filed against the order of First Appellate Authority and PIO of the Organization be dismissed. Taking cognizance of the request made by the appellant, the Jammu Bench of the Commission proposed that in view of submissions made by the appellant, the Chief Information Commissioner may constitute a larger Bench, in case it is deemed fit in the given circumstances for the disposal of appeal filed by the appellant. |
