Court stays newly constituted Committees of All J&K Guru Ravi Dass Sabha 9/30/2015 11:58:35 PM Early Times Report Jammu, Sept 30: In a petition filed by General Secretary Madan Lal Banhalia of All J&K Guru Ravi Dass Sabha seeking declaration to the effect that the Executive Committee and Working Committee of All J&K Guru Ravi Dass Sabha (Regd.) HO, Krishna Nagar, Jammu unilaterally formed by the defendant which was got published in news-paper, Jammu on 15th July, 2015 is illegal and against the provisions of Constitution of Sabha and is therefore, required to be declared as null & void ab-mitio and none being framed without the consent, knowledge and consultation of plaintiff (elected General Secretary) be passed in favour of the plaintiff and against the defendants. With a further decree of permanent prohibitory injunction restraining the defendant from giving any effect to the Executive Committee or Working Committee illegally framed for and on behalf of All J&K Guru Ravi Dass Sabha (Regd.) Head Office, Krishna Nagar, Jammu and also further restraining him from creating any hurdle in the smooth functioning of the Sabha by its elected General Secretary. With a further direction restraining the defendant from interfering or causing any interferance through these illegally framed committees in the smooth functioning of the Sabha, be passed in favour of the plaintiff and against the defendants and further decree of mandatory injunction directing the defendant to strictly adhere to the provisions of Constitution of Sabha so far as it relates to functions, power and duties of President and General Secretary of Sabha and further directing the defendant to hand over all the relevant records, office charge and management to the elected General Secretary of Sabha i.e. plaintiff No. 2 alongwith all its accounts till date to enable the plaintiff to run, manage and control the affairs of Sabha so far as it pertains to the functions of General Secretary be passed in favour of the plaintiff and against the defendants alongwith costs of litigation in the interest of justice, equity and good conscience. Sub-Registrar Jammu Adnan Syed after hearing Sr. Adv BS Slathia with Adv Pawan Kumar Manni, issued notice to respondents and in the meanwhile ordered that the opretion of decision published in newspaper whereby Executive Committee and Working Committee were formed is kept in abeyance and non-applicant is restrained from creating any hurdle in smooth functioning of Sabha by its elected General Secretary till filling of objections from other side.   Share This News with Your Friends on Social Network     Comment on this Story
