Not possible to impose complete ban on liquor: Govt | | | Early Times Report
Srinagar, Oct 06: The state government today said that it was not possible to impose a complete ban on sale and consumption of the liquor in the state. "It is not possible to order total prohibition," Excise Commissioner said in a report submitted by Advocate General Jahangir Iqbal Ganie before a division bench of the court comprising Chief Justice N Paul Vassathakumar and Justice Ali Mohammad Magrey. In the report the excise commissioner has said that no permission has been issued to any person to operate the liquor shops on the national highway, nearby schools or religious places in the state. "Notices have already been issued to shopkeepers operating on the highway," the excise commissioner said. However, the court said that the report has divulged details about the liquor shops along the state highways and hospitals. "The report also says timing has been notified but it has not specifically mentioned as to when the liquor shops should be opened or closed," the division bench said. "This report was received only today and we may be given some time to file the comprehensive reply," the advocate general responded. The bench said that there has to be a label on liquor bottle that "It is injurious to health." Subsequently, it allowed the request by the advocate general to file the comprehensive status report and directed to list the case on October 14. The court was hearing a public interest litigation filed by Karwan-e-Islam, a religious organisation, seeking a ban on the sale and consumption of liquor in J&K. The organization through its chairman Sheikh Ghulam Rasool Hami seeks the court intervention claiming that government has failed to take necessary steps for banning liquor in the state. "Alcohol is freely available at different places in state and the common masses have easily access to such places," the petitioner said. Referring to part-IV of Indian constitution under Article 47, the petitioner says, states shall endeavor to bring about prohibition of the consumption except for medicinal purpose of intoxicating drinks and of drugs which are injurious to health. "Article 38 of constitution of India imposes obligation on states to secure a social order for the promotion of welfare of people and same cannot be achieved without good public health," the petitioner said, emphasizing that it's the bounden duty and obligation of the state to take necessary steps to curb the menace of liquor which has far-reaching ill effects to the health and wellbeing of people in J&K. |
