Service book can not be sought under RTI: SIC | | | Early Times Report
Jammu Oct 6: The State Information Commission (SIC) in a significant order has made it clear that service book of a Government employee is a personal document of the employee and its copy cannot be obtained under the provisions of Right to Information Act (RTI). Details available with Early Times reveal that one Shoket Ali, Advocate, District and Sessions Court, Rajouri moved an application dated: 09.04.2015 before the Public Information Officer (PIO) in the office of Chief Education Officer (CEO), Rajouri under the Jammu & Kashmir Right to Information Act, 2009 wherein he detail of teachers who have taken half pay leave during the months of January and February, 2014 along with detail of salary deducted; Photocopy of their Service Book, complete in all respects, of those teachers who have taken half pay leave of education zone Manjakote; detail of D.A. arrear w.e.f. January, 2012 to December 2014 due in favour of RETs who have been regularized in October, 2009 onwards. The RTI application of the information seeker was transferred to Zonal Education Officer (ZEO), Manjakote vide office No. CEOR/RTI/2015 dated: 16.04.2015 by the PIO/District Education Planning Officer, Rajouri with a direction to provide the relevant information to the information seeker as it pertained to zone Manjakote. The ZEO, Manjakote submitted before CEO / SIC that as soon as the record will be made available in his office, he will provide the requisite information to the information seeker without further loss of time. The records reveal that the first appeal dated: 11.06.2015 filed before the First Appellate Authority (FAA)/ in the Directorate of School Education, Jammu was not adjudicated and disposed of by the FAA. Thereafter, the appellant knocked the doors of the State Information Commission (SIC) by filing 2nd appeal dated: 19.08.2015 in which he has alleged, that PIO as well as FAA has failed to provide him the requisite information, as sought in the RTI application. The Commission after receiving the 2nd appeal discussed the RTI application of the information seeker threadbare and it was found that most of the information sought by the information seeker is personal in nature which may affect the privacy of the teachers appointed under ReTs, such as their Service Book and salary details etc. "Keeping in view the provisions of Section (8)(1)(i) of the Jammu & Kashmir Right to Information Act, 2009 which exempts from disclosure the information which is personal in nature and has no relationship to any public activity or interest or would cause unwarranted invasion of the privacy of the individual, the PIO/CEO, Rajouri and ZEO, Manjakote are hereby directed to take care of this provision while answering the RTI application of the information seeker" reads the SIC order. |
