CBI court discharges valuer in 'loan fraud' | | | Early Times Report
Jammu, Dec 22: In a case of alleged loan fraud of the Bank of Baroda, Gandhi Nagar, the Court of the Special Judge Anti-Corruption (CBI Cases), Jammu Vinod Koul Chatterji has discharged property valuer valuer H R Phonsa at the time of framing charge. In the landmark judgement announced by the court for the FIR No RC 0042013A0003 CBI/ACB/Jammu, the valuer Hem Raj Phonsa has been exonerated. In the judgement, the Special Judge Anti-Corruption (CBI Cases), Jammu Vinod Koul Chatterji observed that the investigating agency has not been able to prove that the valuer was at fault to rely upon the mortgagor for identification of the property for which the valuation report was given. Court observed that the valuer was not duty bound to take the assistance of revenue officials or bank officials for the purpose of the identification of the property and also observed that the valuer has no role to verify the title of the property documents and his role is limited to the valuation of the property only. Accordingly, the judge pronounced that the investigating agency has failed to make out a case of conspiracy against the valuer H R Phonsa. Hence forth, the valuer has been discharged and charges framed against other accused in the case shall be examined after five days from the statement was recorded. --(JNF) |
