United Front for Social Justice (UFSJ) to hold 'Maha Rally' | | | Early Times Report
Jammu, Dec 22: Focus to strengthen the movement for the implementation of Court's Decision of No reservation in promotions, United Front for Social Justice (UFSJ) for General Category J&K announced to organize a Massive Rally on 27 December (Sunday). The objective of the Rally is to pressurize the state government to make all the arrangements to implement the court's order in letter and spirit so that justice can be done at an earliest. The rally namely, "Maha Rally" will be assembled near Hari Singh Park and will be culminated at City Chowk Jammu. While addressing the press conference Ayaz Mughal said, "Reservation in promotion is illegal and unjustifiable and it has become stumbling block on the way to the development of the society." "Government seems to be slipshod towards the court's decision which came about three months back but has not implemented it yet and it is our utmost demand from the state government to implement it without any further delay" he added Satish Sharma, member UFSJ said, "The undue reservation quota system had disheartened the majority of the employees as the illegal benefit was given to employees appointed under different categories of reservation." "Due to on-going policy most of the employees are facing injustice which has now been made clear by the JK High Court's decision and it's the duty of the state government to implement the order as it will benefit to majority of the employees who faced the injustice due to undue reservation system". Earlier on October 09, the Division Bench of High Court has struck down struck down Section 6 of J&K Reservation Act 2004 and Rules 9, 10 and 34 of Reservation Rules 2005 declaring it as "invidious and unconstitutional", observed that the reservation in promotions doesn't have constitutional protection in J&K since the clause (4A) that was added to the Article 16 through 77th constitutional amendment was not applicable to the State. Division Bench of State High Court Comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal, held that there shall be no benefit of reservation in promotions in State of J&K and struck down Section 6 Jammu and Kashmir Reservation Act 2004, and Rules 9, 10 and 34 Jammu and Kashmir Reservation Rules 2005 as ultra vires. The Division Bench struck down the section 6 of Reservation 2004 which authorizes the State government to provide reservation in promotion by framing rules and consequently High Court struck down the Rule 9 of Reservation Rules 2005 which provides percentage of reservation to various categories for the promotion and also struck down Rules. Members of UFSJ have appealed all the public particularly Employees, Students & Traders to join the rally in good numbers to make it successful. |
