JMC files ATR in HC confirming major violations by ex-revenue minister

Jammu, Jan 1: In the PIL, seeking initiation of action against an ex-revenue minister for raising unauthorised construction of his residential house at Deeli near marble market here, Jammu Municipal Corporation (JMC) today told the high court that major violations had been committed by the former minister.
High court judge Bansi Lal Bhat had on December 3 last directed JMC commissioner to take action warranted under law with regard to the alleged major violations committed by the ex-revenue minister in the construction of his house in contravention of the approved site plan. The JMC was also directed to file Action Taken Report (ATR) within three weeks.
The JMC commissioner today filed the ATR wherein it was disclosed that JMC's Building Operation Controlling Authority had granted building permission to the ex-minister vide permit No 848/BS/11 on October 31, 2011 and according to it, major violations had been committed in the construction.
The ATR stated that the minister's house was inspected along with a team of State Vigilance Organization and after measurements conducted on July 3, 2015, it was found that he had raised construction in contravention to the provisions of sanctioned plan.
It said a show cause notice under Section 7(1) of J&K Control of Building Operations Act, 1988 was also served upon the ex-minister vide No MJ/CEO/41/1/2015 on December 16, 2015. He submitted reply to the show cause notice and after consideration of the reply and perusing the record, another notice under Section 7(3) of J&K Control of Building Operations Act, 1988 vide No MJ/CEO/41/3/2015 was served upon him on December 21, 2015, directing him to demolish the unauthorised construction within five days from the date of the notice failing which it would be demolished at his own risk and cost.
The ATR said that the ex-minister had filed an appeal before the J&K Special Tribunal which had passed an order of status-quo. (JNF)
