Contempt case : Court directs SHO who appeared in person to file reply | | | Early Times Report
Jammu, Jan 22 : In response to contempt petition filed by one Lal Zohra mother of girl Kushnoor Aslam burnt to death at Zanana Park, Jammu by one Sanjay Sharma, who happens to be brother of Police Inspector - Rajinder Sharma then SHO Police Station Gandhi Nagar, the Chief Judicial Magistrate Jammu Suneet Gupta today directed the then SHO Police Station Pacca Danga Jammu Kuldeep Khajuria to file his reply on or before February 12 As the hearing was taken up, counselor for petitioner A K Sawhney with Advocates Neeraj Singh and Mohd Akram submitted that the contemnor Kuldeep Khajuria -a Police Inspector and was then posted as SHO Police Station Pacca Danga Jammu has committed contempt of Court by making a false statement in the Court of Chief Judicial Magistrate (CJM) Jammu that the investigations in the complaint under section 302 RPC filed by the petitioner have not proceeded due to an interim order of the High Court, whileas fact was that the interim order had in 2013 been vacated by the High Court and Justice J R Kotwal of the J&K High Court Jammu had directed to proceed in the matter under law. Counselor for petitioner also sought court direction to seek a fair, impartial and professional investigation in the complaint titled Lal Zohra V/S Sanjay Sharma. He submitted to court that during proceedings on 2/11/2015 the respondent- SHO Police Station Pacca Danga was directed to appear in person. The counsel for petitioner A K Sawhney also submitted that Police is not conducting fair investigations into the complaint of the petitioner which involves serious offences of 302 RPC and on these counts the Police has stopped proceeding with the investigations just to give benefit to the accused and cause failure of justice for the petitioner. "The accused is leisurely enjoying his life under the patronage of his brother being an officer of the Jammu Police, under the support and abetment of the other conspirators who are officers of the Police department and now the respondent on 2/11/2015 had made a misleading and false statement before this Court where has taken refuge under the Order of the Hon'ble High Court which was vacated way back in 2013, Sawhney added. He said it is a serious offence committed by the respondent besides dereliction of duties and offence under section 166 RPC for which the petitioner shall move appropriate petition if required. |
