Royal Palm cheating case: Choudhary's son, accountant denied bail | | | Early Times Report
JAMMU, Apr 9 : In the Royal Palm cheating case, 1st additional sessions judge, Jammu, M A Choudhary today rejected the pre-arrest bail applications of Amarnath Choudhary's son Radhey Shyam Choudhary and accountant Kaka Ram. Amarnath, alleged to be the main accused, was arrested by the crime branch sleuths two days back, following the denial of pre-arrest bail to him by the court. Rejecting the bail application of Radhey Shyam and Kaka Ram, son of Dhani Ram, the court also revoked the interim bail granted in their favour vide the March 17, 2016 order. A land belonging to owners - Amarnath, his wife Mohini Devi and son Radhey Shyam -- was developed into a commercial mall by M/s Riddhi Siddhi Infra projects Pvt Ltd. As per the agreement between them, the sale recovery was to be shared in the ratio 35:65 by them. The duo invited offers from public for the sale of shops and other commercial sites. After the company completed its job, the letter of offer of possession for fitouts was to be issued by the company to respective buyers in January 2015. As the developers being non state subjects were not able to buy or sell any property, this task was required to be executed by the land owners, who kept dilly dallying the matter by making fake excuses and assurances, received their share of crores without executing any sale agreement, thereby depriving more than 200 investors of their money. The land owners in furtherance of criminal conspiracy allegedly hatched with Kaka Ram, with malafide intention and to unsurp the entire property, had misled the buyers and the developer company through deceitful means. The court said, "They have cheated and misappropriated the hard earned money of investors under a conspiracy and they are not entitled to be admitted to bail in anticipation of their arrest as allegations against them are very serious and colossal in nature. The anticipatory bail is meant to protect those who genuinely apprehend false involvement in criminal cases at the behest and hands of influential persons or unscrupulous elements and apparent perpetuators of frauds and falsehood cannot take the refuge and shelter thereunder to hide themselves from systematic scanners and avoid accountability on the pretext of their self proclaimed innocence particularly in the cases involving against public at large and against society." With these observations, the court rejected their bail. |
