Jammu, Apr 14: E bid for opening & running chain of "24x7" of pharmacy shops within the hospital premises being allegedly flouted by the Jammu and Kashmir Medical Supplies Corporation Ltd dated 27.11.2015 has sparked controversy as a fresh case has been filed before the J&K High Court, Jammu on the ground that the tender was allotted to non state subject holder besides, its process, procedure and allotment has created hostile classification, contrary to the public policy, interest, objective and purpose. The case was filed after M/S Sanyog Enterprises Pvt. Ltd 'Sanjog House 'B-1,Yadav Park,Nangoli Delhi was allotted the tender of opening of 57 pharmacy shops with in the hospital premises in Jammu. Advocate K.K Pangora, who appeared before the court as counsel apprised the court that the petitioners namely Indu Rattan and others are aggrieved of the NIT dated 27.11.2015, its process, procedure and allotment in favour of M/S Sanyog Enterprises Pvt. Ltd 'Sanjog House 'B-1,Yadav Park,Nangoli Delhi vide award dated 9.3.2016. The above acts create hostile classification, contrary to the public policy, interest, objective and purpose. The allotment is in violation of Govt Order No 492-HME of 2008 dated 17.6.2008 as the allottee is the Non State Subject and participation is restricted to Permanent residents of the state only. The NIT and award is against the Public policy and violative of the rights of the petitioners by ousting them to participate in the bid by imposing unreasonable conditions of the having turn over more than 10 Crores for 3 consecutive years, hence this petition. Meanwhile, the court has directed the State of Jammu and Kashmir Department of Health and Medical Education Civil Secretariat,Jammu through Commissioner /Secretary, J&K Medical Supplies Corp. Ltd (Public Sector Undertaking of Government of Jammu and Kashmir),Corporate Head Office, Drug Store Building Govt Mdical College Bakshi Nagar,Jammu through its Managing Director and M/S M/S Sanyog Enterprises Pvt.Ltd 'Sanjog House ' B-1,Yadav Park,Nangoli Delhi through its Managing Director to file objections in the week commencing 2.5.2016. |
