PIL disposed, HC says laying of power cable is in public interest | | | Early Times Report
Jammu, Aug 16: A high court division bench of Justice Dhiraj Singh Thakur and Justice B S Walia today said the laying of power cable by the state was in the interest of public and any attempt to stall the upgradation of transmission line would be detrimental to the public interest. The court directive came in a PIL, seeking dirtection to the respondent from moving ahead with the project of laying of power cable under Restructured Accelerated Power Development and Reform Programme in Jammu region. A direction was sought to the respondents to delay the said programme for a period of six months on the plea that it would lead to power cuts in Jammu region for approximately 10-15 hours a day and being the peak summer season, it would cause undue hardship and misery to the people of Jammu. The bench, after hearing both the sides, observed that the programme, being undertaken by the state 'is in the interest of public and any attempt to stop it from upgrading, strengthening or augmenting the transmission system would be detrimental to the public interest at large. It is clear that such a programme being undertaken by the respondent is likely to result in reduction of transmission losses, check leakages as also perhaps in the interrupted supply of power to the consumer'. The bench obsererved that the public interest 'lies in allowing the project to the completed rather than to stall the it simply on account of some anticipated difficulty which might be faced by the consumers in Jammu due to some interruption in power supply'.
