Jammu, Aug 24: In a PIL, highlighting the alleged hushing up of Rajouri Development Authority (RDA) scam, wherein instead of registering an FIR despite the approval of director of state vigilance organization (SVO), the case was converted into regular departmental action (RDA) against the delinquent officers, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today directed the senior AAG to file the status report as regards the appointment of new inquiry officer (IO) in the case. The 'delinquent' officers included then RDA CEO Mohammad Javed Khan (now custodian general), then executive engineer Khushal Chand, executive engineer Devi Dass Heer and JE Gurcharan Singh. After hearing the two sides, the bench directed the senior AAG to file the status report on behalf of GAD secretary within one week in terms of the May 2, 2016 division bench order read with the July 28, 2016 order indicating the appointment of new IO for holding departmental inquiry against Khan and other suspects allegedly involved in the RDA scam. Earlier, the petitioner's counsel submitted that no status report had been filed by GAD in terms of the two high court orders as regards the appointment of new IO for holding departmental inquiry against the erring officers. The AAG, appearing for GAD, submitted that the requisite status report could not be filed in view of the prevailing situation in Kashmir and sought a week's time. (JNF) |
