PIL challenging PPP contract in SSH disposed of | | | Early Times Report
Jammu, Sept 27 : A high court division bench of first puisne judge, Justice Ramalingam Sudhakar and Justice B S Walia today disposed of a petition, challenging PPP contract in super speciality hospital (SSH) here. The court directive came in a petition, seeking quashment of the contract entered between the state and the private respodent and declare it as void and unenforceable. The PIL had also sought direction to the government doctors and medical officers not to meet medical representatives of private medicine manufacturing companies during office hours at the cost of patients and prescribe medicines to patients on salt basis and not those suggested by specific private medicine manufacturing companies. The bench disposed of the petition with the observation that the petitioner had stated that relief No 2 and 3 had already been granted vide interlocutory order of this court dated February 26, 2015 and implemented by the respondents. As far as the first relief which related to a contract between the state and private respondent No 9, stating that it was illegal, had also now become infructuous. "It is admitted as a matter of fact by both sides that the contract has been cancelled and the cancellation is the subject matter of challenge before this court," the bench said.(JNF) |
