Complainant alleges FIR not registered under relevant sections

Jammu, Nov 13: Sub Judge Jammu postponed the process in the complaint and in order to ascertain the allegations in the complaint sent it for enquiry under section 202 CrPC to SDPO East (Narwal) with the direction to enquire into the matter and file the report by or before next date of hearing on November 28, 2016.
As per complainant, Shamim Begum wife of Mumtaz Ahmed of Bathindi some locals who eyed their property; on October 20, 2016 trespassed her house by breaking the main gate of the her house and started cutting trees in the land of the complainant.
"Complainant resisted the accused but accused namely Mir Alam son of Ch Ahmed Din manhandled her, snatched golden chain from her neck and started beating with lathies and blows", reads the compliant.
"Meanwhile, accused identified as Bashrat Ali son of Mir Alam , Ab Satar son of Mir Alam and Rehana Choudhary wife of Ab Satar dragged the complainant from her hair and tore her clothes and started capturing her pictures", alleged complainant.
Complainant further alleged that when her husband reached home accused namely Sajad Ali alias Tikka son of Noor Alam Anayat Ali son of Fateh Mohd of Reasi presently staying at Bathandi and Bashir Ahmed son of Mohd Din of Bathindi started beating her child and threw her on fire owing to which she received burn injuries", alleged complainant.
She further alleged that the accused entered in her house with iron roads and sharp-edged weapons with intention to kill her and her husband and also threatened to vacate the premises immediately.
She further stated in the compliant that she was shifted to Govt Hospital Gandhi Nagar wherein doctors referred her to Government medical College and Hospital (GMC&H).
"The matter was immediately reported to the in-charge police post Bathindi for registration of FIR who registered the FIR against some of the accused but not under relevant provision of law", alleged complainant.
Complainant further alleged that accused persons had been booked in an FIR under Militancy related cases.
Complainant alleged that Investigation Officer and in-charge police post Bathindi in connivance with accused has not registered the case under relevant provision of law while accused regularly threatened her to withdraw the complaint against them or else they implicate them in fake and fabricated NDPS case.
Complainant further that she had approached higher authorities but justice was not provided to her.
