Jammu, Nov 24: Principal Sessions Judge, Reasi, S R Gandhi today awarded life impriosnment to a murder accused. One Kartar Singh of Ransoo, Reasi had lodged a complaint with Pouni police post on February 14, 2009, alleging therein that his son Joginder Singh had been murdered by Pawan Kumar, son of Hans Raj of Ransoo as he (deceased) had a land dispute with Pawan Kumar alias Thoru, Ashok Kumar alias Shama, Ravi Kumar Kohli and Sanjay Kumar Kohli, all residents of Ransoo. Complainant stated on the day of the incident, Pawan came to him and started abusing him. Heated arguments took ugly turn when Pawan alongwith otherts accused assaulted him and then threw him in a drain. When he tried to come out of the drain, Pawan hit him on his head with a shovel resulting him fatla injuries Hearing the hue and cry, Kamal Singh, Pari Ram, and Mohinder Singh arrived at scene on this the accused fled away. The injured was shifted to Ransoo dispensary from where the doctor referred him to Pouni hospital. After hearing the public prosecutor, the judge sentenced Pawan to undergo imprisonment for life for the commission of offence under section 302 of RPC. Court also fined Rs 10,000 and said in default of payment of fine, the convict was ordered to further imprisonment of 6 months. Awarding the sentence, the court observed that the victim belonged to the lower strata of the society as for his sustenance. Keeping in view this fact, the court deems it proper not to saddle the convict of the liability to pay the compensation and recommended that compensation in terms of section 545-A CrPC made vide SRO 229 of April 23, 2013 might be granted to the legal heirs of the victim A copy of this judgment be submitted to the chairman of District Legal Service Authority, the court said. --(JNF) |
