Revenue Deptt fails to implement HC order

jammu, Mar 17: Despite High Court order to Revenue Department Jammu to take necessary action on a petition against alleged illegal construction on agriculture land in violation of Agrarian Reforms Act at Khanpur Nagrota, the former has failed to execute the order in letter and spirit even after the lapse of three months. Besides, it has been alleged that the police of concerned area is also not cooperating with the Revenue Department to stop the illegal construction.
As per documents, one Sanjay Talwar had filed a petition in High Court against the illegal construction over a land bearing Khasra No. 93 situated at Village Khanpur Tehsil Nagrota District Jammu which comes under the ambit of Agrarian Reforms Act 1976. By going through the petition, High Court directed the Revenue Department to implement the order dated 16-11-2017 passed in WPPIL No. 29/2017, MP No. 1/2017 titled Sanjay Talwar V/s State of J&K and Ors.
Accordingly, the Assistant Commissioner Revenue, Collector Agrarian Reforms Jammu directed the concerned Tehsildar under letter no. DCJ/ACR/Reader/2017-18/252-54 dated 6-12-2017 to take necessary action as warranted under law.
As per representation by the petitioner, two persons namely Ram Rattan son of Kalyan Dutt and Ludri Ram son of Paras Ram Resident of Khanpur are executing illegal construction in Khasara No 93 over the agriculture land. Consequently, Assistant Commissioner Revenue asked the concerned Tehsildar to personally visit the spot and submit the detailed report along with the relevant revenue record in case there is illegal construction so that proceeding U/S 28A of Agrarian Reforms Act 1976 be initiated against the violators. ACR also asked the Tehsildar to take assistance of local police if required while implementing the order of High Court on the spot.
Shockingly, despite the directions from ACR Jammu, no action was taken by the concerned official. The petitioner again moved an application with ACR Jammu for non implementation of order as a result ACR Jammu issued an another order on 13-03-2018 to concerned Tehsildar and SHO Nagrota to immediately stop the illegal construction but concerned police has not implemented the order till date which indicates some dubious intensions of police.
