BJP backtracked on abrogation of Article 370, lawyer asks Vohra to create history | | | Early Times Report srinagar, June 27: Days after the fall of the PDP-BJP government, the debate over abrogation of Article 370 has started gaining momentum yet again as a lawyer has also written a letter to Governor N N Vohra for its removal. The BJP had promised people of abrogating the Article 370 before the elections. Once coming to the power, it maintained a silence and said that it cannot abrogate it as the coalition had to run as per the Agenda of Alliance. As the JK is under the Governor rule, all eyes are on N N Vohra how he will deal with the controversial issue. Advocate at Allahabad High Court, Udit Chandra, has written to the Governor N N Vohra to use his powers and recommend the removal of Article 370. History always remembers people for not what they could have done but what they have done. Your entire life speaks volumes of good deeds, you have done for the country," the letter reads. The letter further reads, "Now, history is knocking at your door once again and it is upto you to open the door and let your name be written in golden words, in the pages of history or you can be content with huge contribution already made by you for this country." In his letter, Chandra has talked about the features of Article 370 and the difference between the Governor rule in J&K and other states of the country. "The Governor can take all the actions which are necessary for enforcing the proclamation. The said actions include, executive functions, as mentioned in the article 92(1) (a) of the government as well as the legislative function (as mentioned in Article 92(4) of the constituent assembly's concerned," reads the letter. "It also has the power to suspend the entire constitution of J&K, if required," he said. RSS chief Mohan Bhagwat has also said that Article 370 has harmed JK rather than benefitting it in any way. The issue is also pending before the Supreme Court. The main petition was filed by Delhi-based NGO 'We the Citizens' in 2014. Subsequently, three more petitions, including that of West Pakistan refugees were filed, challenging the Article, which were clubbed. Article 35A is a provision in the Constitution that empowers the J&K Legislature to define permanent residents of the state. It was added through the 'Constitution (Application to Jammu and Kashmir) Order, 1954', issued under Article 370. |
