SIC seeks OMR sheets for RTI applicant

srinagar, July 13: State Information Commission (SIC) has directed JK Services Selection Board (SSB) that OMR sheets of selected candidates for the post of Finance Inspectors be provided to an information seeker under the provisions of Right to Information Act (RTI). The PIO had denied to share the information earlier citing 3td party information and when the aggrieved complained before SIC about the same the PIOs claim was set aside by Commission by directing SSB to provide copies of the OMR sheets to the information seeker.
Details available with Early Times reveal that a complaint filed by Mohammad Ramzan Khan a resident of Dharambugh Kralpora Budgam had arisen out of non-implementation of the directions of the State Information Commission in case file No. SIC/CO/SA/658/2018 dated 12.11.2018 by the PIO, J&K Service Selection Board (JKSSB). The PIO was directed by SIC to undertaken the procedure as enshrined in Section 11 of the J&K RTI Act, 2009 in respect of third party information and seek views of the concerned 3rd parties.
After receiving comments from the 3rd party, the PIO was to take a decision in accordance with the law regarding disclosure or otherwise of such information. It was also directed that if the PIO arrives at a decision that the 3rd party information can be disclosed keeping in view the public interest, he should furnish the information to the appellant under an intimation to this Commission. In case, the PIO felt that the public interest was not involved in disclosing the third party, he should convey his decision to the Mohammad Ramzan Khan and also to the Commission.
This procedure was to be completed in 30 days.
The complaint for non compliance came up for hearing before the Commission on 12th June, 2019 at Srinagar . The complainant Mohammad Ramzan Khan was present in person during the hearing. The PIO JK SSB was also present during the hearing. The PIO submitted that since the information sought pertained to the third party and an exercise under section 11 of the J&K RTI Act, 2009 was carried out. Only one candidate has responded informing the PIO that his OMR sheet should not be shared with the appellant. Rest of the candidates have neither given their consent nor informed the Board that the information be not shared with anyone.
State Information Commissioner M A Mir after hearing the parties disposed of the complaint with a direction to the Public Information Officer (PIO) SSRB to provide the information in the shape of OMR sheets of six selected candidates to the appellant and also of Irfan Mohammad Khan. SIC directed that these OMR sheets shall be provided to Mohammad Ramzan Khan within a period of two weeks from the date of receipt of commission's order.
