Court acquits BMO Ganderbal in trap case | | | Early Times Report Jammu, July 29: Special Judge Anticorruption Kashmir RN Wattal today acquitted Ghulam Ahmad Mir S/o Abdul Aziz Mir R/o Rawalpora Budgam then BMO Ganderbal in trap case as Anticorruption Bureau miserably failed to prove its case. Brief facts of the case are that on 27-10-2003 the complainant Saleema Bano who was working as sweeper under the administrative control of accused then B.M.O Ganderbal, lodged a written complaint with Vigilance Organization with averments that the accused B.M.O Ganderbal demanded Rs. 5000/- as illegal gratification through his orderly Abdul Aziz for rectifying obliteration in her service book. The complainant begged for the mercy but the accused B.M.O Ganderbal was adamant. Accordingly, the FIR No.33 of 2003 under section 5 (2) P.C.Act was registered at P/S VOK and investigation in the case commenced, trap team was constituted headed by A R Lone DySP. Special Judge Anticorruption Kashmir RN Wattal after hearing both the sides observed that rule of criminal jurisprudence is that the prosecution has to prove the guilt against the accused beyond any reasonable doubt but in the instant case he is of considered view that prosecution has miserably failed to sustain the charge against the accused u/s 5(2) P.C. Act r/w section 161 of RPC beyond any reasonable doubt. |
