PIL against illegal encroachment in old city | DB directs JMC to file detail report | | Early Times Report
JAMMU, July 29: In a Public Interest Litigation highlighting the illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex, Mohalla Old Hospital Road, Near City Chowk, Jammu and also in the old city, a Division Bench of High Court comprising Justice Dhiraj Singh Thakur and Justice Sindhu Sharma after hearing Adv Ajay Sharma for the PIL, directed JMC to file detailed report. The DB observed that during the course of hearing Adv Ajay pointed out that it was both in front of Jambulochan Hall and the park adjacent to it has been encroached by the hawkers selling fast-food items, which operates mainly in the evening hours from 5 p.m. onwards till late at night. It was sated that the width of the track is not more than four feet. While leaving no space for the pedestrians to walk, they are forced to walk the distance on the main road. A number of accidents are reported to have been occurred on account of the traffic congestion. It is also stated that another shop has opened selling non-vegetarian items, which causes a lot of traffic nuisance on account of the illegal parking of the vehicles in the said area, leading to the choking of entire road every day in the evening. It was sated that the Municipal Corporation ought not to have permitted any such activity, considering the fact that this road is one of the main road, which links the old city with the Janipur area, Kachi Chawni, Mubarak Mandi and is otherwise required to be clear. It is stated that the congestion on the road hampers the movement of ambulances. B. S. Salathia, senior counsel also add his grievance that lot of illegal parking of vehicles is taking place in lane No. 1 & 2, leading to unnecessarily choke in the area, which is purely a residential area and access to which is choked on account of the illegal parking. The DB further observed that another issued highlighted is the fact that the Municipal Corporation is permitted the construction of four storeyed commercial complex on the Manda - Amphalla road, without in the least considering the fact that the said commercial complex has no parking space and that the service road to Karan Nagar locality get choked in the times to come on account of the commercial activity, which will run from the said permission. Upon this DB directed Commissioner JMC to furnish detail of whether the Municipal Corporation or the authority under the Food Safety and Standards Authority of India (FSSAI) has permitted the food-joints to run their establishments from the foot-path, if yes, the details of such permission so granted and Whether aforementioned two departments have permitted the selling of non-vegetarian items, which invariably lead to traffic congestion on the road and whether the requisite permission was proceeded in the compliance of the provisions of the Municipal Corporation Act and the rules and the FSSAI. |
