jammu, Feb 6: The State Information Commission (SIC) has issued penalty show cause notice against Tehsildar North Jammu as the said officer failed to discharge his duties as Public Information Officer (PIO) while he was posted as Tehsildar Bishnah . The said officer had not provided information about Mutation and copies of Fard e Intikhaab one information seeker who alleges that he was done illegally in favour of his brothers after the death of his father. The information seeker who works with Border Security Force (BSF) finally filed a complaint against the officer before State Information Commission (SIC) who issued penalty notice against the then Tehsildar Bishnah presently posted in tehsil North Jammu.
Details available with Early Times reveal that one Sat Paul, S/O Sewa Ram R/O Village Harsa Dabber, Tehsil Bishnah, at present STC. BSF, Bhakundpur, P.O. Bhakundpur, Seliguri (West Bengal ) moved an application dated 26.06.2014 before the PIO/Tehsildar, Bishnah under the Jammu & Kashmir Right to Information Act, 2009 wherein he sought the information regarding mutation of his father Sewa Ram, S/O Faquar V/S (1) Sat Paul, (2) Joghinder Pal,& (3) Guleshan Karara R/O Bishnah Ward No.12 . He also sought copy of Fardintkhab (if any ) issued in favour of Joghinder Pal, Gulshan Karara, Kartar Chand under Khasra No.422 situated at Village Harsa Dabber, Tehsil Bishnah.
Feeling aggrieved of inaction on the part of the PIO/ Tehsildar, Bishnah, the complainant filed a complaint dated 01.10.2014 before the State Information Commission (SIC) wherein he alleged that Tehsildar, Bishnah has not provided him a copy of the Fard Intkhab and mutation, etc. which was entered and attested in his absence in favour of brothers of the applicant. The Commission (SIC) after receiving the complaint listed the matter for hearing on 18.11.2014, 29.12.2014 and 19.01.2015. As the complainant is serving in the Border Security Force, posted at Seliguri West Bengal , he was represented by one Sansar Chand on 18.11.2014 and 29.12.2014.
On 19.01.2015 the complainant was personally present before the Commission and apprised that there is an inordinate delay on the part of the PIO/ Tehsildar, Bishnah in providing the requisite information sought in the RTI application dated 26.06.2014. The complainant admitted before the Commission that he received the attested copy of Fard Intkhab on 30.09.2014 after about three months when the complaint was lodged against Tehsildar before SIC . During the course of proceedings held at SIC Jammu office on 19/1/2015 the PIO/Tehsildar, Bishnah furnished to the complainant an attested copy of the mutation sought by the information seeker. Gopal Singh, Tehsildar, Bishnah apprised the Commission that he has taken over recently the office of the Tehsildar, Bishnah and RTI application was filed by the complainant during the tenure of Mohammad Sayeed, then Tehsildar, Bishnah who is now posted as Tehsildar North, Jammu. Prima-facie there is delay in furnishing the information to the information seeker which should have been made available within thirty days from the date of filing the application.
While taking the matter seriously , the SIC issued penalty show cause notice against the former Tehsildar Bishnah who is presently posted as Tehsildar North Jammu. |
