Petition by Col seeking quashment of proceedings in GCM dismissed | | | Early Times Report
Jammu, Apr 4: In a petition filed by Col Rajesh Mehta seeking qaushment charge sheet/proceedings of GCM (General Court Marshal) against him for alleged splitting the bills relating to purchase of certain equipments so as to bring the split bills within his competence when he (petitioner), 14 Electronics and Mechanical Engineers Battalion, Justice Janak Raj Kotwal of J&K High Court Jammu Wing dismissed petition with the direction to avail alternative remedy available to him. Justice Janak Raj Kotwal of J&K High Court Jammu Wing after gone through file observed that the grievance of the petitioner and the principles summarized by the Supreme Court in Commissioner of Income Tax no case for judicial review of the orders passed by the GCM in exercise of writ jurisdiction under Article 226 of the Constitution ignoring the availability of alternative remedy under section 15 of the Act of 2007 is made out. Remedy available under section 15 rather is more efficacious. With these observations State High Court dismissed the petition with the direction that it open for the petitioner to avail alternative remedy available to him. (JNF) |
