HC stays termination of Adhoc Anganwari Workers/Helpers

Jammu, Apr 30: In a petition filed by Adhoc Anagwari Workers/Helpers who are aggrieved of the Govt Order issued by Social Welfare Department whose services has been terminated, Justice Tashi Rabstan of J&K High Court Jammu Wing directed Social Welfare Department to allow the petitioners to continue in the Centres where they are presently working in terms of their engagement/extension orders and also restrained the state from replacing the petitioners by any other temporary arrangement/substitute.
While staying the order, Justice Tashi Rabstan observed that the petitioners have filed the present petition seeking quashing of Order No.13-SMD of 2015 dted 22/04/2015 issued by the Mission Director, ICDS, J&K, terminating the stop gap/adhoc arrangements of all Anganwari Workers with immediate effect and the case was listed on April 28, 2015 when the respondents were directed to maintain status-quo with respect to the present position of petitioners till 29/04/2015 and was directed to be kept on Board for today.
Court took serious note and observed that it is strange that the respondents with one single stroke have terminated the services of all stop gap/adhoc Anganwadi Workers with immediate effect without making any alternate arrangement to function the Anganwari Centres.
It observed that statement of Deputy AG Ranjeet Jamwal that the Anganwari Centres still exist and are not closed, leads to the conclusion that the services of Anganwadi Workers are still required by the respondents. Some of the engagement orders of petitioners even reveal that they have been allowed to continue till the final selection is made by the competent authority. Court directed respondents to allow the petitioners to continue in the Centres where they are presently working in terms of their engagement/extension orders.
However, this order is subject to objections from other side and till next date of hearing before the Bench only. (JNF)
