HC directs implementation of SHRC order in youth's killing | | | S Sabaqat

Srinagar, May 22: The state High Court has directed government to implement State Human Right Commission's order, recommending ex-gratia relief of rupees one lakh and benefit of SRO-43 to a family members of a youth killed at Anantnag in south Kashmir in 1994. Disposing of a petition filed by the youth's sister Shakeela, a single bench of the court comprising of chief justice N. Paul Vasanthakumar directed Chief Secretary, Commissioner Secretary Home, Commissioner Secretary GAD and Deputy Commissioner Anantnag to implement the recommendations within eight weeks. In the petition, Shakeela submitted that her brother Abdul Hameed Makroo got swayed by militancy and in the year 1994 crossed over to LoC. After some time, he returned back and was arrested by the army, she said. After serving the jail for six months, he was released and he later confined to himself to domestic engagements only. "He went to see his maternal aunt wherefrom he was kidnapped by some unidentified gunmen and later on killed. His dead body was found on 13.09.1994 on a nearby road of Gund Khali Naina," she said. The FIR in the case was registered on the orders of the Chief Judicial Magistrate, Anantnag and Makroo's father knocked the doors of all the concerned officers, but no relief was paid to him. Subsequently, their father filed a complaint before the SHRC in 2009. The Commission, after considering the reports of the Police Chief of the State and other materials, recommended to the State Government and District Administration to sanction and pay ex-gratia relief of Rs one lakh in favour of next of kins. In addition, the SHRC extend benefit of SRO 43 of 1994 in favour of the eligible next of kins. When no action was taken, Shakeela filed the petition before the high court on 29.12.2012. However the respondents' took no action and they even did not file any objections to the petition. "In such view of the matter, the petition is disposed of with a direction to the respondents to implement the order of the SHRC within a period of eight weeks," the court said. |
