Shoddy investigation leads to acquittal of alleged Charas Smuggler | | | Early Times Report
JAMMU, June 17: (JNF):- Principal Sessions Judge Jammu Mr. RS Jain acquitted Muddasar Ahmed s/o Muzaffar Hussain r/o Malerad, tehsil Reasi alleged Charas Smuggler, as witnesses examined by the prosecution revealed a number of contradictions and non-observance of the mandatory provisions of the NDPS Act during the investigation. Police case against accused Muddasar Ahmed is that on 20.4.2012, Kamal Kishore, Incharge police post ChowkiChora filed a docket averring therein that at camp Kathar that on 20.4.2012 he along with poloicepersoneel were on petrol duty in Kathar area and during the naka near the brick kiln, Kathar were checking the vehicles when at 4.30 PM, one person coming from side of JD towards Kathar and on seeing the police party tried to run away. That the person was apprehended after a chase and gave his name to be MudasarNazar and from possession of the said person, one yellow coloured plastic bag bearing the name of Fancy Fabrics, Anantnag was recovered which contained another black bag which was found to be containing 14 challis of charas weighing 750 grams and the same was seized on spot, after completion of investigation challan was presented. Principal Sessions Judge Jammu . RS Jain after hearing Adv AR Khan appearing for the accused observed that perusal of the testimonies of the witnesses examined by the prosecution reveal a number of contradictions and non-observance of the mandatory provisions of the NDPS Act during the investigation. The prosecution has failed to prove the guilt of accused beyond reasonable doubts by cogent and clear evidence, as such, accused Mudasar Ahmed is acquitted. |
