| Recruitment of Assistant Professor Urdu in BGSBU | | HC stays selection process | | Early Times Report
Jammu, June 17: In a significant order, Justice Janak Raj Kotwal of J&K High Court Jammu Wing, has stayed the selection process for the post of Assistant Professor Urdu advertised by Baba Ghulam Shah Badsah University Rajouri issued Vide advertisement notification dated May 29, 2015.
After hearing of Dr.Mustaq Ahmed Wani, Justice Janak Raj Kotwal observed that petitioners' grievance briefly is that post of Assistant Professor Urdu in BGSBU has been advertised again vide impugned advertisement notification dated May 29, 2015 without completing the selection process pursuant to earlier advertisement notification No BGSBU/Estab/11/3779-3799 dated July 22, 2011.
Petitioners' contention is that he had been selected under the earlier notification and had also submitted NOC from the Education Department where he is presently serving.
Justice Janak Raj Kotwal after considering the submissions of counsel issued notice to the Vice Chancellor BGBSU, Registrar returnable within four weeks for filling their response and in the meantime till next date before the Bench, stayed the selection process qua the post of Assistant Professor Urdu.
In the petition, petitioner submitted that the respondents cannot be allowed to proceed with the impugned advertisement Notification as the same is violative of the initial advertisement which culminated in petitioner's selection but the petitioner was picked up for hostile discrimination by the respondents for the reasons best known to them.
The respondents cannot be permitted to play with the career of the petitioner and directions may kindly be issued to the respondents to re-call the impugned advertisement as the same is illegal and violative of Article 14 and 16 of the Constitution of India.
In the petition the petitioner has prayed for the quashment of the advertisement notification dated May 29, 2015 qua one post of Assistant Professor in Urdu as the petitioner stands already selected/recommended by the Selection Committee pursuant to the selection initiated vide advertisement notification dated July 22, 2011.
The petitioner has also prayed that the respondents be directed to issue the appointment order in his favour for the post of Assistant Professor Urdu. (JNF) |
