HC grants 2-week time to secretaries of GAD, Housing, Revenue to respond | Chatha-Sunjwan Land Scam | | Early Times Report
Jammu, Sept 16: In a PIL, highlighting the alleged hushing up of Chatta-Sunjwan land scam, a high court division bench of Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal issued notices to secretaries of GAD, Housing and Urban Development Department and Revenue Department, vice-chairman of JDA, Ram Kumar, son of Paras Ram, M/s SRK Associates, then Naib-Tehsildar Bahu, Mohammad Iqbal Zargar, and then Patwari, Sunjwan, Mohan Singh, then patwari Sunjwan in a miscellaneous petition seeking appropriate action against all those officers/officials of JDA who failed to take action against M/s SRK Associates on the directions of Housing and Urban Development Department issued vide No U&D/15/2008/ JDA/AS-32 dated February 5, 2008 whereby then JDA V C had been directed to take necessary action to re-visit/put on hold the building permission granted in favour of M/s SRK Associates. After hearing the counsel appearing for the PIL, the bench issued notices which were accepted by the senior AAG and counsels for other government functionaries. The bench also granted two weeks time to the counsels for respondents to respond to the Miscellaneous Petition. In the Miscellaneous Petition it is also highlighted that M/s SRK Associates has disclosed in its application for impleadment that they are co-owner of the land measuring 724 kanals situated at Sunjwan and the said land is in the shape of Gair Mumkin Khad, Banjar Qadeem and slope. It is alleged in the Miscellaneous Petition that 724 Kanals of land is in excess of the ceiling prescribed under Section 2(1) of J&K Agrarian Reforms Act, 1976 and the excess land is required to be retrieved from M/s SRK Associates. After considering the submissions of the counsel, the bench issued notices to the secretaries of GAD, Housing and Urban Development Department, Revenue Department, JDA VC, Ram Kumar, M/s SRK Associates and Zargar and Mohan Singh, both patwaries, and also directed them to file their response within two weeks.(JNF)
