LA session likely to be stormy over beef issue | | | Early Times Report
Jammu, Sept 19 : The ensuing session of the state legislature beginning from October 3 in Srinagar is going to be stormy on the issue of ban on slaughter of bovine cattle and consumption of beef in Jammu and Kashmir. The issue has already kicked up regional passions with majority of people in the Kashmir valley favouring revocation of the ban on beef consumption, and majority of people in the region of Jammu supporting ban on beef consumption. Apart from this the state has been gripped by a new controversy when the Government moved Additional Advocate General Mahesh Sharma for his failure to defend the writ petition seeking ban on bovine slaughter. CPI (M) leader and MLA Kulgam MY Tarigami Friday submitted a Private Member's Bill to the J&K legislative Assembly Secretariat seeking repeal of Section 298-A, B, C and D of Ranbir Penal Code (RPC), which criminalise the sale and consumption of beef in the state. Tarigami said section 298-A, 298-B, 298-C and 298-D of Ranbir Penal Code fall under the classification of offences relating to religion and violate the constitutional guaranteed fundamental rights of the personal life, freedom and liberty of the citizens of Jammu and Kashmir state and amounts to the unwarranted interference to the inalienable rights of the state subject, moreover, is not constitutionally valid piece of legislation. "The present 'Bill' seeks to delete Section 298-A, 298-B, 298-C and 298-D of State's Ranbir Penal Code, Samvat, 1989 and corresponding provision of Code of Criminal Procedure Samvat, 1989, as it is de-hors and violative of the basic structure of the Constitution and doesn't qualify the ingredients of constitutionally valid law," he said. Meanwhile, BJP MLA also moved a resolution today in the Assembly demanding capital punishment for those found slaughtering the bovine animal in the state. BJP MLA from Nowshera assembly constituency Ravinder Raina has moved a resolution in the assembly in which he has asked for a complete ban on cow slaughter and sale of beef as per the directions passed by the High court."Those who are found guilty should be awarded capital punishment" the resolution read. The National Conference has already planned to move a bill seeking amendment to the 1932 law that bans cow slaughter and consumption of beef in the state. This way it is going to be not only BJP versus its alliance partner the PDP but it may be a tussle between the legislators from Jammu and those from the Kashmir valley. Indications are that in case the BJP toughens its stand against amendment to 1932 law it may lead to a fresh constitutional crisis which may place the state under the Governor's rule to be followed by fresh Assembly elections.
