HC directs state to file response within 4 weeks | PIL against alleged fake category certificates | | Early Times Report
Jammu, Oct 3: In a PIL filed by Mohammad Anwar Choudhary, member of State Advisory Board for the Development of Gujjar and Bakerwal against alleged fake ST category certificates, seeking implementation of the August 24, 2012 court order whereby a division bench had directed state to set up Scrutiny Committee at division/district level to scrutinize social status certificates of reserved category. A high division bench of Justice Hasnain Massodi and Justice BS Walia observed that counsel appearing for the petitioner stated that the government order claimed to have been filed in the compliance of order is not in tune with the law laid down in Madhuri Patil's case and therefore amounts to disobedience of the court order. Upon this, the bench observed that this instant miscellaneous petition, therefore, is in the nature of contempt petition as petitioner essentially seeks compliance of court order and punishment to respondents for disobedience of the court order and treated the petition as contempt petition and directed state to file response within four weeks. It is worthwhile to mention here that on August 24, 2012, a bench had disposed of the PIL with a direction to the state to bring the mechanism under the Reservation Act and Rules for grant/ issuance of Reserved Category Certificates at par with the directions of Supreme Court so that all the chances of any mal-practice at the stage of grant/issuance of certificates are excluded and also directed the setting-up of Scrutiny Committee at Division/District Level to scrutinize the certificates already issued and fixed six months time to comply with the directions.
