DB orders sealing of over two dozen 'shopping complexes' in Srinagar | Directs Com Transport, IGP Traffic to appear in person | | Early Times Report Srinagar, Nov 27: A Division Bench of J&K High Court comprising Justice M H Attar and A M Magrey has ordered sealing of over two dozen shopping complexes in Srinagar for lack of basement parking facilities also and directed Commissioner Secretary Transport and IGP (Traffic) to appear in person. When the hearing over a PIL was taken up, the Division Bench followed perusal of a status report filed by SMC that there are about 27 out of 47 buildings which still lack the basement parking facilities. "The Srinagar Municipal Corporation is under statutory obligation to initiate action against these shopping mall owners which includes demolition of these buildings. Till the action in accordance with law is taken for demolition of these buildings, the SMC shall seal all these buildings and report compliance within a week's time to the Registrar Judicial of this Court," the Division Bench said, adding that the Commissioner, SMC shall be personally responsible for executing the order of the Court. "In order to facilitate sealing of these commercial complexes/ shopping malls, Inspector General of Police, Kashmir Range is directed to provide all necessary police protection to (SMC). The owners of these commercial shopping complexes are directed not to offer any resistance to the sealing of their complexes. Violation of this order would make them liable for committing contempt of the Court," the Division Bench added. Regarding former congress minister Taj Mohi-ud-Din, the SMC said that a notice was issued to him for restoration of car parking in his complex here on 3 September and in response, he stated that matter is subjudice before the High Court (in OWP No.1757/2012). The court further said, "Every authority is bound to discharge its duty to secure the overall welfare of the people. It is deemed appropriate at this stage to direct Transport Commissioner and IGP Traffic, to appear in person before this Court on next date. Meanwhile the court directed completion of for lanning of Qazigund-Srinagar Section of NH-44 byJuly 31 next year. "The National Highways Authority of India (NHAI) shall complete the four laning of the Qazigund-Srinagar section NH-44 by31st July, 2016, it added. "The Authority must put to work the manpower and machinery to achieve the aforesaid target within the aforesaid time frame. No reason or cause will be accepted in delaying the completion of the aforesaid four laning of Qazigund-Srinagar section." The Division Bench also directed the Divisional Commissioner Kashmir to ensure handing over of the acquired land to the National Highways Authority of India within two weeks and file compliance report in this behalf before the next date." |
