HC directs Udhampur DC, SSP to implement civil court order of status quo
Dispute over religious place at Basantgarh

Jammu, Dec 10: High court judge Muzaffar Hussain Attar has directed deputy commissioner, senior superintendent of police and tehsildar of Udhampur, SDPO, Ramnagar, and SHO of Basantgarh police station to implement the August 12, 2014 order of civil court of sub-judge (CJM, Udhampur) whereby it had directed both the parties to maintain status quo with regard to the suit land covered by khasra No 1078/164 at Basantgarh, Ramnagar.
The court directive came in a petition filed by Mohammad Din, son of Rustam Ali of Lodhra, Basantgarh. After hearing the two sides, Justice Attar directed that DC, Udhampur, SSP, Udhampur, and SDPO, Ramnagar, would ensure that life, liberty and property of the petitioner was protected and all these authorities would file compliance report before the trial court within two days.
The petitioner's counsel submitted that despite the status quo order of sub-judge, Udhampur, the authorities at the helm of affairs were hell bent to forcibly dispossess the petitioner from his 10 marlas of land.
Justice Attar observed that "ours is a country governed by the rule of law. Constitution of India provides protection to all the people who live in this country. Article 14, which provides equality before law and equal protection of laws, is the soul of the Constitution and it does not discriminate between the people on the basis of their faith, religion, caste or creed. Article 14, in fact, is unifying factor amongst the people belonging to different faiths, religions, castes and creeds. It guarantees unity, integrity of this country. This court has to seek compliance and obedience of the constitutional provisions from all".
He observed that in "our constitutional scheme, courts have been created for resolving disputes between the parties. The orders of the court, until such time they are vacated or modified, have to be implemented, otherwise, there will be anarchy in the society. Every citizen/individual is duty bound to respect and obey the court orders". With these observations, Justice Attar disposed of the writ petition. (JNF)
