RTI Activist denied information from CS denies info under RTI Act | | | Javaid Naikoo Early Times Report Srinagar, Feb 13: The Chief Secretary has been accused of denying information under the RTI Act. A social activist, Sajad Ahmad of Budgam on December 03, 2015 filed an application under RTI Act-2009 in the office Chief Secretary to seek details regarding Department of Health services Kashmir. The questionnaire which Sajad had filed among other questions comprises 'details of job assigned to MMPHW's, reasons of no recruitment of MMPHW's,any guidelines with government which prohibits recruitment of MMPHW's,staff strength of Hospital Sub centers,vacany of MMPHWs'and FMPHW's District wise.' However instead of any information to Sajad in connection with his RTI Application, concerned department through a letter vide GAD (admn) 113/2015 dated 31/12/2015 informed him that he had not provided any fee and matter does not pertain to GAD. GAD also asked him to seek details from concerned department by furnishing a postal order worth Rs 10. Sajad Said that in order to enjoy complete freedom under RTI act-2009 of not paying any amount as fee in return of information he had in advance submitted one zerox copy of his BPL Ration card vide number 1882988 as well. This is not the only case where any RTI activist of Kashmir was denied information from government offices and made to suffer by one way or the other. Sajad Said that in similar other case he was denied information from District Hospital Budgam despite fulfilling all mandatory norms under RTI Act 2009 to seek information. Another RTI Activist Gulzar Ahmad of Khag told early times that in recent two attempts he was denied information from Block Development department and Public Health Engineering department Budgam with impunity. Gulzar said that he sought details about sanction and utilization of funds with area wise break up from Block development department Khag and utilization of funds meant for Muharam Procession from Public Health Engineering Department Budgam. However, he alleged that in both cases he was denied information and this has become a routine. A legal expert said that consuming more time than stipulated 30 days to share information with any RTI applicant is direct violation under section 7(1) of the Jammu and Kashmir RTI Act 2009 as the first reply shall furnish within 30 days of time anyhow. |
