Forward order copy of 'committee for preventing harassment of Women: SCW to HODs | | | Ishtiyaq Ahmad
Srinagar, May 26: The Jammu and Kashmir state commission for women has directed HODs of all the government departments to forward order copy of committee framed for the prevention and redressal of harassment of women at workplaces within one week. According to the letter which is in the possession of Early Times, the commission has directed all the Commissioner Secretaries including Secretaries, Financial Commissioners, Director General of Police, Registrar general Jammu and Kashmir High court, IGP vigilance, Divisional Commissionaires, Managing Directors, Directors, and other heads to favour the commission with order copy framed for above purpose. The letter reads "In order to redress the grievances of women employees at workplace, it s mandatory for all the departments to constitute internal complaint committee where female employees can register their complaints (if any) so that the said complaints can be disposed of by the committee". "In this regard, I am directed to request to favour this commission with order copy framed for above purpose within one week. In case the internal complaint committee has not been constituted, the same may also kindly be done within a period of one week," the letter reads. It is to mention here that Chief Minister Mehbooba Mufti had asked all District Magistrates and Administrative Secretaries to setup internal complaints committees to look into and prevent sexual harassment of women at workplaces. The instructions came after an alleged sexual assault case came to fore in an Indian System of Medicines hospital in Srinagar outskirts. However sources said that only some departments so far has constituted the committees for the same. "Most of the government departments have failed to constitute Internal Complaint Committees (ICCs) despite the fact that the government had directed administrative heads of all departments to constitute ICC to address all complaints of harassment of women at workplaces," source said. "The Civil Secretariat has constituted a complaint committee for women employees of the Civil Secretariat. The committee has been directed to submit report to the GAD on each complaint received by it regarding sexual harassment against women employees of the Civil Secretariat and quarterly/annual reports about the total number of complaints received, enquired and action taken on the same. Sources said that only out of the existing corporations JKI has come forward, implemented the government decision and also constituted the ICC to check sexual harassment in the department. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 mandates that all the workplace which include any department, organization, undertaking, establishment, enterprise, institution, office, branch or unit which is established, owned, controlled or wholly or substantially financed by funds provided directly or indirectly by the appropriate Government or the local authority or a Government company or a corporation or a co-operative society having more than 10 workers to constitute Internal Complaint Committee (ICC) for receiving complaints of sexual harassment. The Act cast an obligation upon all the employers to constitute Internal Complaint Committee. If any employer fails to constitute an Internal Complaint Committee, or contravenes or attempts or abets contravention of other provisions of this Act or any rules made there under, he shall be punishable with fine which may extend to fifty thousand rupees. |
