Even after DC's notice info denied | Land Acquisition by NHPC at Gurez | | Early Times Report
srinagar, Aug 18: Though the deputy commissioner, Bandipora, who is also the First Appellate Authority (FAA) under State RTI Act had issued a notice to Tehsildar Gurez for not providing information to an aggrieved party whose land was acquired by National Hydro Electric Corporation (NHPC) during ongoing construction of Hydro Electric Project on Kishen Ganga river in Gurez area, the information was yet to be provided to the applicant. Details available with Early Times reveal that one Ghulam Mohamad Lone of Kandyal, Gurez, filed Second Appeal on June 1, 2016 under RTI Act 2009 before State Information Commission (SIC). The appellant says that he had filed an application before Tehsildar Gurez on January 15, 2016, seeking record of land under Khasra No 91 situated in Halqa Badwan Wanpora, Gurez, and details of compensation of land acquired by NHPC for Kishan Ganga Power project. As no information was furnished, he preferred First Appeal before the DC, Bandipora on March 17, 2016. The DC issued a letter to PIO/Tehsildar Gurez on April 7, 2016, but neither the First Appeal of the appellant was considered nor the outcome of First Appeal filed before the DC was communicated to him. The appellant alleged that the land under Khasra No 91 has submerged under Kishan Ganga River since 1959, but now it is shown to be in possession of respondents who had been growing maize on it. He accordingly requested to provide him the relevant record, seeking action under RTI Act against the officer who had failed to act as per provisions of the Act. Tariq Ahmad Sheikh, Tehsildar Gurez, and appellant Ghulam Muhammad Lone had appeared before SIC on June 23 last for 2nd appeal hearing . The DC had sought exemption for appearance stating his preoccupation with the visit of Parliamentary Standing Committee on Home Affairs on June 23, 2016. The DC (FAA) filed reply before SIC submitting that appeal presented by the appellant was disposed of within stipulated time whereby an order was passed directing PIO for delivery of information forthwith without further delay and explanation was called for non delivery of information. He said he decided the appeal on April 7, 2016 by passing an order wherein directions were given to the Gurez tehsildar to provide the information to the appellant directly under the relevant provisions of the Act forthwith without further delay and also explain as to why he may not be penalized for non-delivery of information as per provisions of the Act. The tehsildar filed reply before SIC on June 8, 2016, submitting that records pertaining to survey No 91 of estate Badwan Wanpora had been dispatched to the applicant vide letter dated April 10, 2016. He said information relating to extracts of record of rights 1959-60, Jamabandi extract 1971, Girdawari extract 1972, Girdawari extract of the year 2012 and copy of Khasrah paymaish prepared during the acquisition process involved under Kishan Ganga Hydro Electric Project had been provided to the applicant. The tehsildar informed the appellant that his office had not received any kind of application, so question of non response 'does not arise'. As per reliable sources, complete information about Land Acquisition process is still not being provided to the information seeker who now plans to file a non-compliance report before SIC. |
