Court directs SSP to probe into 'lathicharge' on dam affected families | | | Early Times Report
jammu, Sept 1: Sub-judge (special mobile magistrate), Kathua, Sunil Sangra has directed SSP, Kathua, to hold preliminary inquiry into the August 1, 2016 incident of police lathicharge on the families affected by Thein dam under section 202 of CrPC. He also directed the SSP to submit the report of investigation in the court on or before the next date of hearing, ie September 10 next, besides giving due representation to the affected persons during preliminary inquiry. The court directive came in a complaint filed by 15 aggrieved persons, seeking direction to the Lakhanpur police station SHO to register FIR in terms of section 156 (3) of CrPC against additional deputy commissioner Bharat Bhushan, Kathua tehsildar Avtar Singh, naib-tehsildar Bhoj Raj, DSP Kuljeet Singh, and Lakhanpur police station SHO Ripesh Sambyal. Their counsel submitted that they, along with 500 affected persons of Thein dam belonging to 22 villages of Basohli and Mahanpur, were peacefully protesting near Golden Gate, Jakhatpur Morh, near Lakhanpur at about 9 am against the authorities concerned on the issues of rehabilitation, compensation, submergence of unacquired land and unemployment caused due to the construction of Thein dam project at Basohli when police and civil authorities arrived at the spot. It was alleged that police lathicharged and humiliated the protesters, including women, without any provocation and also showered abuses on them. The judge, after hearing the counsel, observed that the petitioners had levelled serious allegations againt the civil and police authorities. He said due to inaction on part of police to register FIR against the officials, the petitioners had approached the court. He said 'it feels that before registration of FIR, it is imperative to ascertain the truth or falsehood of the allegations and it seems proper to conduct preliminary enquiry into the matter before issuing the process against the non-applicants'. With these observations, the judge directed SSP, Kathua, to conduct preliminary inquiry into the alleged matter under section 202 of CrPC and submit report in the court on or before the next date of hearing, ie September 10. |
