HC asks police to proceed in FIR against BJP MLC over illegal construction | | | Early Times Report
Srinagar, Oct 18: The state high court has directed police to 'proceed in accordance with law' in an FIR registered against BJP's MLC Ajatshatru Singh over illegal construction at Sonawar here. Hearing a PIL, a division bench of Justice M H Attar and Justice A M Magrey also warned Ajatshatru against any violation of its orders, statute and undertaking which the grandson of J&K's last king, Maharaja Hari Singh, filed before the court through his counsel. In his undertaking, he has stated that he will not raise any construction on the site and shall abide by the rules and court directions. "Any breach of the court orders, statute and undertaking will be viewed seriously," the court said. FIR No 95/2016 under section 188 of RPC (Disobedience to order duly promulgated by public servant) has been registered against the MLC at Police Station, Ram Munshi Bagh. Regarding probe by a retired session judge into alleged misbehavior by Minister for Youth Services and Sports Imran Raza Ansari with Enforcement Officer of LAWDA Suhail Hussain Reshi (DySP), the Advocate General assured the court that direction in this connection will be complied within a week's time. He submitted that his office had not informed the Chief Secretary of the state about the court order and the compliance report in this behalf be filed within one week before the Registrar Judicial. The Court also directed the enquiry officer to complete enquiry within five weeks thereof and submit report in a sealed cover to Registrar Judicial. In September this year, the court had appointed Syed Javed Ahmad, retired Principal District and Sessions Judge, as the enquiry officer, after Ansari as well as Reshi, stuck to their claims. While the cop reiterated that Ansari "abused and threatened" him for taking action against those who had raised illegal constructions at Lashkari Mohalla near Habak on Dal peripheries, Ansari, the minister for Information Technology, Technical Education and Youth Services & Sports, rejected his claims as baseless. In other direction, the court sought show cause from Hotel Grand Palace as to why action for sealing the hotel be not taken for not complying with the court orders. The said hotel was directed to replace the STP and in this connection PCB had also issued notice to the management of the hotel. Hotel Management has been directed to show cause as to why coercive action including sealing of the hotel should not be taken against them and court directed the management of the hotel to reply within two weeks about the issue. The court also asked the amicus to attend and participate in all the scheduled meetings of monitoring committee so that the government 'proceeds further in the matter, more particularly for enacting the law for preservation of Dal lake and other water bodies'. The court observed that the functioning of monitoring committee had come to a standstill because of non-participation of the advocate in the committee. The bench was also informed that the physical demarcation of 200 meters of zone from the periphery of Dal and Nigeen lakes, prohibiting area for raising any kind of construction, had been started by excavation and progress of completion of the project shall be filed by filing status report before the next date of hearing. |
