Kishtwar Nov 19 : Chief Judicial Magistrate, Kishtwar, Balbir Lal Jaswal on Friday awarded 2 years imprisonment to a man in a theft case. Accused Chander Parkash, son of Yash Pal of Chomti Bonjwah, had broken into a house and and committing theft. He was booked by Kishtwar police under sections 457, 380 and 201 of RPC. After completion of inquiry, police had presented the challan in the court of CJM, Kishtwar. Although he pleaded 'innocence' at the time of framing of charges, after a trial of nearly two years, he confessed to the crime in open court. The judge told him that he was not bound to confess the charges, and if he 'confesses to the crime, he shall be convicted and appropriate sentence will be passed against him'. Accordingly the opportunity of thinking over the matter was granted to him and matter was posted after one month but on the day of hearing, he again pleaded before the court that he wanted to confess the charges. Keeping in view the gravity of offence, recovery of stolen items and their estimated cost, the judge said since general masses 'feel insecure by the act of such offenders, the provision denoted in the Probation of the Offenders Act and section 562 of CrPC do not come in rescue of the accused'. With these observations, the court convicted the accused and awarded him two years simple imprisonment under section 457 of RPC and two years under section 380 of RPC. Both the sentences would run concurrently. |
